By downloading, installing, or using Dark Pool Monitor (the app), you agree to these Terms of Use. If you do not agree, please do not use the app. These terms apply to the app on both iOS and Android.
The app presents statistical information about public market data, including a Dark Index (DIX), dealer gamma exposure (GEX), off exchange volume ratios, regime labels, and related indicators. This information is provided for general informational and educational purposes only.
The app is not a financial advisor, broker, or fiduciary. Nothing in the app is investment advice, a recommendation, or an offer or solicitation to buy or sell any security or other financial instrument. The content is not tailored to your personal circumstances.
Past behavior does not guarantee future results. Markets carry risk and you can lose money. You are solely responsible for your own investment decisions. You should do your own research and consider consulting a licensed financial professional before acting on any information in the app.
The app and its data are provided on an as is and as available basis, without warranties of any kind, whether express or implied. Data is derived from public sources such as FINRA and market data providers and may be delayed, incomplete, or inaccurate. Single stock readings in particular are noisy, and many low volume or over the counter names have little or no reliable data. We do not warrant that the app will be uninterrupted, timely, or error free.
Some features require a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play, not directly by us. Payment is charged to your store account at confirmation of purchase. Subscriptions renew automatically until cancelled, and your account is charged for renewal within the period before it ends. You can manage or cancel a subscription at any time in your store account settings. A free trial, where offered, converts to a paid subscription unless cancelled before the trial ends. Purchases made through Apple are also governed by Apple's standard license agreement (EULA).
To the maximum extent permitted by law, VZMotivation and the app's developer are not liable for any trading or investment losses, or for any indirect, incidental, or consequential damages, arising from your use of, or reliance on, the app or its content. You use the app at your own risk.
You agree not to misuse the app, including attempting to disrupt its operation, reverse engineer it except where permitted by law, or scrape or redistribute its data for commercial resale.
We may update these terms from time to time. The current version will always be posted at this address, and continued use of the app after an update means you accept the revised terms.
